MonkeDAO Goes Bananas With $2 Million Acquisition
MonkeDAO, an independent Solana Monkey Business holder collective, has successfully acquired the intellectual property rights of SMB, a popular Solana-based NFT project, alongside all associated assets, keys, and accounts from Hadeswap for $2 million. The aquisition comes after a series of disputes between MonkeDAO and the creators of SMB regarding royalty payments.
Here are the quick facts:
MonkeDAO now owns the intellectual property rights of SMB, a popular Solana-based NFT project.
The aquisition was made for $2 million from Hadesswap, a Solana NFT exchange.
HadesDAO authorized the governance proposal, with 97% community members voting in favor of the takeover.
MonkeDAO formed around SMB's Gen2 launch and has been actively participating in managing the Solana newtork validator, attending in-person events, and ivesting in startups surrounding the project.
SMB has a trading volume of $164 million, according to CryptoSlam data.
The acquisition of SMB's intellectual property rights by MonkeDAO highlights the importance of collaboration and negotiations in the growth and success of NFT projects.
Apple's NFT Tax Deemed Illegal By U.S. Court
Fortnite developer, Epic Games, has won a landmark case against Apple's 30% tax on NFT transactions, with the US Court of Appeals ruling the tax was anite-competitive and in violation of California's Unfair Competition Law. The decision could disrupt the NFT market and change the way they are sold on the popular app store, and may also have implications for the wider crypto industry.
Here are the quick facts:
The ruling was part of a re-evaluation of a lawsuit brought by Epic Games against Apple in 2020.
Apple's mandate for developers to use their in-app payment system for NFT transactions was deemed anti-competitive and stifled innovation.
The decision could lead to lower NFT prices and increased market competition.
Web3 app developers may benefit if the ruling remains.
The outcome of Apple's appeal is still incertain.
This ruling could be a step in the right direction towards fairer competition in the NFT market. It will be interesting to see if other companies follow suit, and if Apple will make changes to its App Store policies moving forward.
Apple prevailed at the 9th Circuit Court. Though the court upheld the ruling that Apple's restraints have "a substantial anticompetitive effect that harms consumers", they found we didn't prove our Sherman Act case.

NFTs Battle For Trademark Protection: Bored Apes Take The Prize
A judge in California has granted trademark protection to a the Bored Ape Yacht Club (BAYC) NFTs owned by YugaLabs, after ruling that they have specific uses and values that depend on consumers. This comes after Ryder Ripps, a conceptual artist who created similar NFTs, was sued by Yuga Labs for "trolling" the comapny and "scamming" consumers.
Here are the quick facts:
Yuga Labs sued conceptual artist Ryder Ripps for creating copycat Bored Ape Yacht Club NFTs.
The judge ruled that the BAYC NFTs have trademark protection because they have specific uses and values that depend on consumers.
The judge denied any artistic merit in Ripps' NFTs and also ruled in favor of YugaLabs in a cybersquatting dispute.
The amount of damages Ripps owes will be determined in a later trial.
The price of bored apes NFTs has declined from their April 2022 highs.
While this decision may have come too late for most NFT projects, it sets a precedent for future trademarks disputes in the industry.
i already won a DMCA against Larva Labs in July, We shall see if Yuga Labs will want to pursue this in court.
